Disposal Process

Whirledge & Nott has been instructed to handle this important disposal of residential development land at Bury Farm, Bury Lane, Hatfield Peverel, Essex CM3 2DH.

The site extends to approximately 2.26 Hectares (5.58 acres).

The site is being marketed via an informal tender with your maximum bid required to be submitted via email to Martin Jordan by 12 noon on the 31st January 2018.  

Further tender details will be provided to interested parties a week before the bids are due.

Preference will be given to unconditional offers.

Conditional offers may be considered, full details of any conditions need to be set out within the tender submission.

The Site

The site is located off Bury Lane, Hatfield Peverel on the north side of the village.

Bury Farm is currently a complex of farm buildings occupied by several small businesses, a small paddock and existing residential cottages.

The site is bounded to the north by the railway line and sits adjacent to the ARLA ex-dairy site which has a resolution to grant outline planning for 142 residential units.

To the south of the site are other residential properties and a residential development proposal on land known as Sorrells Field.

The site presents an excellent opportunity to create a unique quality development within a rural setting.

Opportunity

The Vendors main focus is the unconditional disposal of the land with planning permission.

There is potential for variations to this which can be submitted as alternative bids. These are as follows (refer to the coloured hatching on the site plan).

1. Four existing cottages shown within the land hatched blue on the site plan. These cottages are within the application boundary and the Vendors preference is to sell these with the main site subject to receiving market value for them. We would therefore request that details are provided as to the value placed on these four cottages within your bid.

2. A substantial unlisted period house in extensive grounds known as The Bury which is currently divided into three apartments (shown within the land hatched green). This property is currently excluded from the sale. The Vendor would consider an additional offer for this property and area of land. Such an offer must be submitted as an alternative variant bid to the main site.

The site benefits from a number of residential and commercial tenancies (all of which can be terminated upon relevant notice periods). Parties can either assume that the site will be sold as a vacant freehold site or may wish to consider continuation of the existing tenancies to provide an income stream. Details of the various tenancies including a schedule of rents will be made available upon request.

Planning

The site benefits from a resolution to grant outline planning consent subject to the entering of a Section 106 Agreement (S106) (planning reference 17/00341/OUT) for:

‘Application for outline planning permission, with all matters reserved with the exception of access, for the erection of up to 46 dwellings (Use Class C3), public open space, vehicular access and associated infrastructure’

The S106 is currently being negotiated. A copy of the draft S106 is available within the information pack. Parties will be required to provide comments on the draft S106 and confirm that full allowance for the provisions of the draft S106 have been taken into account in presentation of the offers.

Restrictive Covenants and Easements

The land is sold subject to any easements or covenants annexed to the land, including rights of access and services to the existing cottages, adjacent house known as Mortiers, the ARLA ex-dairy site and the telecoms mast situated on the edged of the site.

We understand that the land benefits from mains sewerage, electricity, water and BT.

Retained Rights and Obligations

The sale will be subject to the following rights and obligations:

1. A right of way for agricultural purposes will be retained through the site to access the farmland to the south west of the site. The location and size of the access way will be discussed and agreed with the preferred party.

2. Rights will be retained for the benefit of the Vendors adjoining farmland. These rights will provide for access and services and allow for upgrading, renewing and connecting into the adoptable road and infrastructure built as part of the development scheme and to connect, lay and install services. Such rights will be required to protect any future development opportunity of the Vendors adjacent farmland.
