Agricultural Occupancy Condition

An occupancy condition on a residential property restrict the occupation of a property to an occupier who is or was last employed in agriculture/forestry or occassionally equestrian.

The removal of the conditions can add significant value and improve the marketability of your property. If it can be shown there is no demand by compliant parties for your property through appropriate marketing then an application can be made to remove the condition. Alternatively if the property has been occupied in breach of the condition for a continuous ten year period then there can be an opportunity to remove the condition through the application for a certificate of lawfulness. There is also the opportunity to vary difficult conditions to better fit your circumstances.  We are well known for our success in removing or varying redundant occupancy conditions and consequently adding value to property.
